📄 Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the services provided by Agra Holidays, a travel company based in Agra, Uttar Pradesh, India, operating at agraholidays.com.

By booking a tour package, cab service or any other service with us — whether through our website, WhatsApp, phone or in person — you confirm that you have read, understood and agreed to these Terms in full.

If you are booking on behalf of other travellers (family members, group), you confirm that you have the authority to accept these Terms on their behalf as well.

🔔 Important: These Terms form a legally binding contract between you and Agra Holidays. Please read them carefully before making any payment or booking.

📋 Booking Process

A booking with Agra Holidays is confirmed only upon receipt of the advance payment and our written confirmation (via WhatsApp or email). The booking process works as follows:

  • You share your travel requirements with us via WhatsApp, phone or website form
  • We provide you with a detailed itinerary and quotation
  • You review, confirm and pay the advance amount to secure your booking
  • We send you a written booking confirmation with all details
  • Balance payment is made as per the agreed schedule (typically before departure)

Agra Holidays reserves the right to decline any booking at its discretion without providing a reason. In such cases, any advance payment received will be fully refunded.

📌 Verbal commitments or enquiries do not constitute a confirmed booking. A booking is confirmed only when you receive our written confirmation and advance payment has been received.

💰 Payment Terms

Advance Payment

A minimum advance payment of 25% to 50% of the total package cost is required to confirm your booking. The exact advance amount will be communicated at the time of booking.

Balance Payment

  • For domestic tour packages: Full balance must be paid at least 7 days before the departure date
  • For cab services: Full payment is typically required on the day of travel or as agreed
  • For group bookings (10+ persons): Special payment schedule will be communicated separately

Accepted Payment Methods

  • UPI (Google Pay, PhonePe, Paytm, BHIM)
  • Bank Transfer / NEFT / RTGS / IMPS
  • Cash (for in-person bookings at our Agra office)
  • Cheque (subject to clearance before booking confirmation)

All prices are quoted in Indian Rupees (₹) and include applicable GST unless stated otherwise.

❌ Cancellation Policy

We understand that plans can change. If you need to cancel your booking, please inform us in writing via WhatsApp or email as early as possible. The following cancellation charges apply:

⚠️ Note: Hotel bookings, flight tickets and third-party services may have separate cancellation policies. Non-refundable components (e.g., advance-paid hotel rooms, event tickets) will be deducted from any refund regardless of the above schedule.

💳 Refund Policy

Eligible refunds will be processed as follows:

  • Refunds will be initiated within 7–10 working days of the cancellation request being confirmed
  • Refunds are processed to the original payment method — UPI, bank account or the source of payment
  • Bank processing time may add an additional 3–5 working days
  • Cash payments will be refunded by bank transfer or cheque
  • Any payment gateway charges are non-refundable

Refunds will not be provided for unused services, early check-outs, voluntarily missed activities or any portion of the tour not utilised due to the traveller's personal decision.

🔄 Changes to Booking

Changes by the Traveller

You may request changes to your booking (travel dates, hotels, itinerary) subject to availability. Changes requested within 7 days of departure may attract additional charges. We will always inform you of any extra cost before confirming the change.

Changes by Agra Holidays

In rare circumstances (natural events, hotel unavailability, transport issues), we may need to modify your itinerary. In such cases:

  • We will inform you at the earliest possible opportunity
  • We will offer a suitable alternative of equal or higher value at no extra cost
  • If no suitable alternative is available and you wish to cancel, a full refund will be provided

✅ Inclusions & Exclusions

Typically Included (unless stated otherwise)

  • AC vehicle with fuel and driver as per the itinerary
  • Hotel accommodation as per the category mentioned
  • Meals as specified in the itinerary (B = Breakfast, L = Lunch, D = Dinner)
  • Licensed local guide (if mentioned in the itinerary)
  • All tolls and parking charges for the vehicle

Typically Not Included (unless specified)

  • Flight or train tickets to/from the starting point
  • Entry fees / monument tickets (Taj Mahal, forts, parks, etc.)
  • Personal expenses — tips, laundry, phone calls, shopping
  • Travel insurance
  • Meals not mentioned in the itinerary
  • Adventure activities — camel safari, horse riding, boating (unless included)
  • Any services not explicitly mentioned in the confirmed itinerary

💡 Always review the confirmed itinerary carefully. If you are unsure about what is included, please ask us before making payment — we are happy to clarify on WhatsApp.

⚖️ Liability

Agra Holidays acts as an organiser and coordinator for travel services. While we take every care to ensure a safe and enjoyable journey, our liability is limited as follows:

  • We are not liable for any injury, illness, death, loss of baggage, delay or damage caused by circumstances beyond our control
  • We are not responsible for the acts or defaults of third-party service providers (hotels, airlines, local transport, etc.)
  • We are not liable for any losses due to natural disasters, political unrest, strikes, road conditions or other force majeure events
  • Our maximum liability in any claim shall not exceed the total amount paid for the specific service in question

We strongly recommend that all travellers purchase comprehensive travel insurance covering trip cancellation, medical emergencies, loss of baggage and other contingencies.

🌪️ Force Majeure

Agra Holidays shall not be held responsible for any failure to perform, or delay in performance of, our obligations due to circumstances beyond our reasonable control. These include but are not limited to:

  • Natural disasters — floods, earthquakes, landslides, cyclones
  • Epidemics, pandemics or government-imposed lockdowns
  • Political unrest, war, terrorism or civil disturbance
  • Strikes, labour disputes affecting transport or hotels
  • Extreme weather conditions making travel unsafe
  • Government or authority restrictions on travel

In force majeure situations, we will make every effort to reschedule your travel or provide a credit note for future use. Refunds in such cases will be subject to recoverable amounts from our service partners.

Cab Service Terms

  • All cab bookings are subject to vehicle availability at the time of confirmation
  • Minimum kilometre charges apply per day (typically 250 km/day for outstation trips)
  • Driver allowance charges apply for overnight stays (usually ₹300–₹500/night)
  • Toll, parking and state permit charges are extra unless specifically included in the quote
  • The vehicle will be provided as per availability — a similar alternative may be provided if the booked vehicle becomes unavailable
  • Passengers are expected to treat the vehicle with care. Any damage to the vehicle caused by passengers will be charged accordingly
  • Smoking, alcohol consumption and carrying of illegal items are strictly prohibited in all vehicles
  • The driver has the right to refuse travel if road/weather conditions are deemed unsafe
  • Cab cancellations made less than 4 hours before pickup will attract a cancellation charge of 25% of the total cab amount

🤝 Traveller Conduct

All travellers are expected to behave in a respectful and responsible manner throughout the tour. Agra Holidays reserves the right to terminate the tour of any traveller who:

  • Behaves in an abusive, threatening or disruptive manner towards our staff, drivers or guides
  • Violates local laws, regulations or the rules of any monument, hotel or attraction
  • Engages in behaviour that endangers the safety of other travellers or service providers
  • Carries or uses illegal substances during the tour

In such cases, no refund will be provided for the unused portion of the tour.

⚖️ Disputes & Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes arising from or related to your booking with Agra Holidays shall be subject to the exclusive jurisdiction of the courts in Agra, Uttar Pradesh, India.

Before initiating any formal dispute, we strongly encourage you to contact us directly — most issues can be resolved quickly and amicably through direct communication on WhatsApp or phone.
